OLDB EUROPE Ltd. reserves the right to unilaterally amend the general terms and conditions. In case of modification, the changed terms and conditions will be published on the website OLDB EUROPE Ltd. will be communicated to the customers separately by e-mail or SMS sent to the e-mail address or mobile phone number provided in their account.

At Cleaning Stuff, we do everything we can to make sure the information about the products we sell is always as accurate as possible. However, because products are regularly improved, the product information, ingredients and allergy advice may occasionally change. As a result, we recommend that you always read the label carefully before using or consuming any products. Please do not solely rely on the information provided on this website Because of this, Cleaning Stuff is unable to accept liability for any inaccuracies or incorrect information contained on this site. This does not affect your statutory rights. This information is supplied for personal use only. It must not be reproduced in any way whatsoever without the prior consent of Cleaning Stuff, nor without due acknowledgement.

What is registration?

 

IMPORTANT! By registering you will create your own account!

As a result of the registration, OLDB EUROPE Ltd. will create a unique user account (ID) and will provide its customers with the opportunity to create their own online account and to participate in periodic marketing promotions organized by OLDB EUROPE Ltd. From your own account you will have immediate access to our webshop.

Who can register?

 

IMPORTANT! You can only register once and each person can only have one discount card!

 

All our customers who are over 18 years of age and of legal capacity, who are resident in a Member State of the European Union and who are able to communicate in Hungarian are eligible to register.

Please note that you are only entitled to register once at a time.

OLDB EUROPE Ltd. controls the use of the registration, the own account and the services available from the own account in accordance with the contract and the law.

A personal account may only be created by natural persons who meet the conditions set out in this clause, not by companies or other legal entities. However, you are entitled to request a VAT invoice when making a purchase in the webshop, under the conditions set out in these GTC, with the designation of companies or other legal entities as the cost bearer.

To validate your registration, you must follow these steps:

1) fill in the registration form on our website;

2) by registering, you accept our terms and conditions and our privacy notice as described here.

 

What to do in the registration interface?

 

IMPORTANT! You can change the data you entered when registering in your account at any time afterwards!

To create your own account, you will need to provide the following login details, your full name, email address, unique password.

To successfully complete the registration process, it is then essential that you complete the "I have read and accept the Terms and Conditions and the related Privacy Policy." check the checkbox next to the text "I accept, acknowledge and accept the Terms and Conditions and the Privacy Policy" and click on the "Register" tab.

If you wish to place an order in our webshop later, you will be asked to provide your telephone number and address (postcode, town, exact address). It is very important that we use the information you provide here to fulfil your order, so the delivery service provider will try to contact you on the phone number you have provided in your account if contact is necessary for delivery, so please check regularly that your number and any other information you provide is up to date.

If you register on the "REGISTRATION" tab on the left, your account will be created immediately after registration and you will receive an e-mail notification of this to the e-mail address you have provided.

You can access your own account by clicking on the "LOGIN" icon on the www.cleaningstuff.eu / cleaningstuff.cz / cleaningstuff.sk / cleaningstuff.hu / cleaningstuff.it / scrubdaddy.cz / scrubdaddy.hu / scrubdaddy.sk website and entering the email address and password you provided during registration. In your own account you can track your orders, enter or modify your order-related data, register a discount card you have not registered before, delete your credit card data (credit cards) you have already saved during your previous purchases, or rename your previously saved credit cards. If you decide you no longer want to use it, you can also delete your own account at any time.

You can immediately delete your account by checking the "Cancel account" box under the "My personal data" tab and clicking on the "REMOVE" button. From the moment you delete your own account, you will not be able to access the areas that are only accessible through your own account;

However, after deleting your own account, you will be entitled to create a new own account again, thus ensuring access to the above www.cleaningstuff.eu / cleaningstuff.cz / cleaningstuff.sk / cleaningstuff.hu / cleaningstuff.it / scrubdaddy.cz / scrubdaddy.hu / scrubdaddy.sk, but you will lose any rights and benefits associated with your previous own account.

 

Audit rights of OLDB EUROPE Ltd.

 

 

 

OLDB EUROPE Ltd. may check the existence of the preconditions for the services it provides, the contractual and legal use of the services at any time. In the case of customers who, for any reason, do not comply with the general terms and conditions or engage in abusive behaviour incompatible with their purpose, OLDB EUROPE Ltd. As a consequence, the customer concerned will not be able to access all the areas that are only accessible through his/her own account. After the termination of the own account, the customer concerned will therefore no longer be able to access the webshop or other periodically organised marketing campaigns and loyalty programmes via his/her own account, using the data previously recorded in his/her own account.

The customer who has acted in a manner contrary to the general terms and conditions or in an unfair manner shall be liable to pay compensation for any damage caused to OLDB EUROPE Kft. in connection with his/her conduct.

How does OLDB EUROPE Ltd. handle incoming complaints?

 

Customer complaints made by telephone will be investigated immediately by OLDB EUROPE Ltd. and will be remedied as necessary and as far as possible.

In the case of online payment by credit card in the webshop, questions and complaints relating to the credit card and the use of the Internet payment interface are the responsibility of the account-keeping bank of the customer concerned and the service provider operating the Internet payment interface. OLDB EUROPE Ltd. will do its utmost to forward such questions and complaints received to the relevant service provider within the appropriate time limit.

If the customer concerned does not agree with the handling of the complaint or if it is not possible for OLDB EUROPE Ltd. to investigate the complaint immediately, OLDB EUROPE Ltd. shall immediately take a record of the complaint concerned and its position in relation to it. A copy of the report shall be sent by OLDB EUROPE Ltd. to the customer who has made the complaint.

OLDB EUROPE Ltd. will provide a unique identifier for all complaints made by telephone and other means.

If you are dissatisfied with the complaint handling activities of OLDB EUROPE Ltd. or if your complaint has been rejected, you can initiate proceedings before the Conciliation Board of the county (capital) chambers of commerce and industry of your place of residence or stay. You can find out about the jurisdiction of each conciliation body at www.bekeltetes.hu&nbsp.

If you feel that OLDB EUROPE Kft. has violated your rights in the course of the complaint handling procedure, you can also contact the metropolitan or county government office responsible for your place of residence. You can find the contact details of the metropolitan government office or the county government offices on the website at http://www.kormanyhivatal.hu/hu/elerhetosegek&nbsp. If you wish to take your complaint to the Conciliation Board, you can do so at the following address:

What is not covered by the liability of OLDB EUROPE Ltd?

 

 

If the customer provides incomplete or incorrect data during the creation of his/her own account or card registration, OLDB EUROPE Ltd. shall not be liable for the customer's failure to provide such data. Buyers shall bear all consequences arising from incomplete and/or incorrect data provided by them. OLDB EUROPE Ltd. is not in a position to verify the accuracy of the data provided by the purchaser, and the responsibility and all legal and financial consequences in this respect shall in all cases be borne by the purchasers.

OLDB EUROPE Ltd. does not verify the identity of individual customers during the registration process and therefore accepts no liability for any misuse of the registration.

By accepting these terms and conditions, you acknowledge that the performance of the www.scrubdaddy.hu/www.cleaningstuff.hu/www.oldb.hu website, message and data transmission and response speeds are dependent on server technology and may be adversely affected by factors beyond the control of OLDB EUROPE Ltd. such as, but not limited to, connection failures, server computer performance and the maintenance of a secure network connection. OLDB EUROPE Ltd. disclaims any liability arising from the circumstances described in this paragraph.

OLDB EUROPE Ltd. disclaims any liability for any external attack on the website or the server hosting it and for any malfunction resulting from such attacks. OLDB EUROPE Ltd. excludes any liability for any failure of the website due to causes beyond its control, during which time it is unusable or restricted, but will immediately take all necessary measures to detect and eliminate the cause of the failure as soon as possible.

Using the webshop

 

 

The webshop is operated by OLDB EUROPE Kft. in order to sell its products via the Internet. The operation of the webshop is considered an e-commerce service.

When do you qualify as a consumer? What does this mean for you?

 

 

If you are a natural person and you are not buying from us for a professional, occupational or other business purpose, you are a consumer under the Civil Code. If you are a consumer, this may give you additional rights when shopping on our webshop compared to when companies, other legal persons or even sole traders shopping with us for the purposes of their profession, occupation or business activity. We set out the rules for consumers in detail everywhere (in particular on complaints handling, withdrawal, warranty rights), so please read them carefully!

 

How can you select the products to order?

 

You can order products from the current range of products in the webshop at OLDB EUROPE Kft. If you click on a product, the webshop will redirect you to the product subpage, where you will find the relevant product information, such as the article number, a brief description of the product and whether it is currently available from stock. From the webshop you can only order products marked as available.

You can use the relevant pages of the webshop to select the products you want to order and specify the quantity. You can place your orders every day between 00:00 and 24:00.

You can check the range, number and price of the products you have selected by checking the contents of your shopping basket.

OLDB EUROPE Ltd. regularly updates the images of the products in its webshop, however, their actual packaging may differ from the packaging shown in the webshop. OLDB EUROPE Ltd. cannot be held responsible for such external discrepancies.

If you click on a product, the webshop will redirect you to the product subpage, where you can see the relevant product features, such as the article number, a brief description of the product and whether it is currently available from stock. The webshop only allows you to order products marked as available.

How much of what can be ordered?

 

IMPORTANT! There is a quantity and value limit for each product category, if you want to order more than this, please contact customer service in advance!

The webshop is primarily intended to serve consumers in the retail sector, so our primary aim is to meet the needs of our customers who are consumers under the Civil Code. Accordingly, we plan our inventory based on consumer orders and their overall volume. In order to ensure that all our consumers have access to the products in our range, we are able to serve a so-called household volume and give preference to orders placed by consumers rather than large volumes of purchases for resale, which are presumably made by the public. OLDB EUROPE Ltd. is able to supply a household quantity of each product category for each order. This means that we can fulfil orders with a maximum of 6-6 (six to six) packaging units (pieces, boxes, packages, bottles, etc.) of each product category, and at the same time the value of the order does not exceed HUF 100,000 (one hundred thousand forints) gross.

 

 

If you are buying for resale and/or you wish to place orders exceeding the quantity and/or value limit, please contact OLDB EUROPE Kft. Customer Service in advance to check the availability of your order, otherwise we may not be able to fulfil your order.

 

Price of the products

 

 

The products are listed next to the gross price at the time of sale, which is the final selling price. For products sold at a discount, the fact and percentage of the discount and the reduced selling price are indicated. The original gross price is also indicated in the detailed description of the products.

OLDB EUROPE Ltd. reserves the right to change the prices of the products, with the proviso that the price change shall take effect at the same time as the change is published in the webshop. This means that any price change will not affect the price of products you have already ordered.

Obviously incorrect price: It cannot be ruled out that despite all due care and attention, OLDB EUROPE Ltd. may display an incorrect price on the webshop interface (in particular in the case of obviously incorrect prices of 0 Ft or 1 Ft, for example, which differ significantly from the generally accepted or estimated price of the product, or which may be due to a system error). In such cases, OLDB EUROPE Ltd. is not obliged to deliver the product at the incorrect price, but is entitled to offer you delivery at the correct price. Knowing the correct price, you can confirm your intention to purchase within 14 (fourteen) days. If you do not confirm your intention to purchase, your order will be cancelled and any sums you may have already paid will be refunded as if you had cancelled your order.

What discounts are available when shopping in the online shop?

 

 

If you agree to our cookie policy, when you enter the webshop you will be presented with product offers that are specifically tailored to you, with a special discount. If you choose not to accept our cookie policy that allows us to create product offers for you, we may offer you our most popular top products at a discount;

When you finalize your order, you can apply the discounts or they will be applied automatically - the discounts that you have been given the opportunity to apply with any of our coupons/discount programs.

Clearly erroneous discount: It cannot be excluded that, despite all due care and attention, the discounts available for the products you have ordered are obviously applied incorrectly by OLDB EUROPE Kft. during the purchase in the webshop, possibly contrary to the rules applicable to certain discounts, which you may have noticed. If, in such cases, the total amount payable for products placed in the shopping basket is obviously and clearly miscalculated by you, OLDB EUROPE Ltd. is not obliged to deliver the product at the incorrect price, but is entitled to offer you delivery at the correct price. Once you know the correct price, you have 14 (fourteen) days to confirm your purchase. If you do not confirm your intention to purchase within this period, your entire order will be cancelled and any sums you may have already paid will be refunded as if you had cancelled your entire order.

Finalise your order

 

 

You can initiate the finalization of the order process by clicking on the "checkout" button in the webshop. As a first step, you need to check the contents of your shopping cart, the products listed in it and the price indicated in relation to them. You can then claim the discounts you are entitled to on the products you have ordered by entering the coupon code. The actual price to be paid for the products ordered using your own account, reduced by the discounts, will be calculated automatically by the webshop, information on which can also be found in the interface for finalising your purchase.

 

Which delivery and billing options can you choose from?

 

 

IMPORTANT! Business companies and other legal entities are not eligible for discount coupons!

Once finalised, you will need to provide the delivery address where you wish to collect the products you have ordered and a billing address. Only one shipping address per order can be provided and the billing address may be different from the shipping address provided. If you have already entered your address during the registration process, this address will automatically be used as the shipping and billing address, but this can be changed on a per purchase basis. If you would like a VAT invoice for your company, please let our customer service department know. We will issue an electronic invoice for the products ordered in accordance with § 175 of Act CXXVII of 2007 on Value Added Tax (2007) § 175 before delivery and send it to the e-mail address you have provided in your account or during the purchase.

Delivery to Hungary is available, you can select the most convenient delivery point for you when you enter your delivery information. The delivery information includes information on the possible delivery areas, delivery times and delivery costs. For the delivery options, you can choose to have your order delivered to the delivery address you specify in Hungary or to a collection point.

You can choose from the following pick-up options:

  • Home delivery: to the Hungarian delivery address you specify, which can be either by OLDB EUROPE Kft.'s own courier, Packeta or GLS;
  • Other pick-up points: pick-up points operated by OLDB EUROPE Kft.

Which payment methods can you choose?

 

You can choose from the payment methods listed below when placing your order:

  • cash on delivery when you receive your parcel, or
  • online payment by credit card after placing your order.

 

Place the order

 

 

Once you have selected the payment method, you can place your order by clicking on the "SEND ORDER" button. By doing so, you also agree that if you have not chosen the delivery method of delivery by OLDB EUROPE Ltd.'s own courier, we will forward your name, the delivery address indicated, your telephone number entered in the delivery details, the order ID and amount, and the e-mail address associated with your account to the company delivering the ordered product in order to fulfil and monitor the contract between us.

Automatic confirmation of receipt of your order

 

 

Within twenty-four (24) hours of placing your order, OLDB EUROPE Ltd. will send an automatic confirmation message to the e-mail address associated with your account or provided during the purchase process, confirming that your order has been received. Unfortunately, if you do not receive this automatic confirmation message, it is possible that due to a technical error your order has not been received by us. In such cases, please contact our customer service to inquire about your order. Please note that an automatic confirmation message does not constitute acceptance of your order by OLDB EUROPE Ltd.

Information letter about your order

 

IMPORTANT! The confirmation of the order will establish the contract between you and OLDB EUROPE Kft.

We will send an information letter about your order to the e-mail address associated with your account, which will inform you about the status of your order. We will normally send you an information letter within three (3) working days of receiving your order. However, if you have placed your order during one of the following priority periods, you can expect to receive an information letter within fourteen (14) working days:

- December 1 through December 26;
the so-called "Black Friday" campaign period announced by OLDB EUROPE Ltd;
- the campaign period for the redemption of coupons valid on shopping days.

If your order complies with the terms and conditions, we will send you a confirmation that we have assembled the package containing the products you ordered. The confirmation will constitute a valid acceptance of the order and a contract will be concluded between you and OLDB EUROPE Ltd. for the products ordered. On the basis of this contract, OLDB EUROPE Ltd. will sell the ordered products to you and arrange for their delivery to the place of delivery indicated by you, and you will be obliged to take delivery of the ordered products and pay the price and delivery costs of the ordered products. 

There are, however, certain cases where additional steps are necessary for a contract to be concluded. These are the following cases:

  • If your order exceeds the quantity or value limit in any of the categories, please contact our customer service in advance, failing which we will not be able to fulfil your order in whole or in part.
  • If your order contains a product for which an obviously incorrect price has been quoted or an obviously incorrect discount has been applied to your order, we will inform you of the correct price of the product concerned and, knowing the correct price, you will have 14 (fourteen) days to confirm your purchase. If you do not confirm your intention to purchase within this period, your entire order will be cancelled and any sums you may have already paid will be refunded as if you had cancelled your entire order.

 

Features of the contract resulting from your order

 

 

The contract for your order will be terminated when the obligations arising from the contract are fulfilled. The contract shall be terminated if either you or OLDB EUROPE Ltd. exercises its right of withdrawal. The contract is a contract between remote parties in Hungarian, which is not in writing and will not be registered.

How can you pay for products?

 

IMPORTANT! When paying online by credit card, your credit card details are handled in accordance with the card company's rules. OLDB EUROPE Ltd. does not have access to your credit card data;

You can pay the purchase price of the ordered products and the shipping costs by cash on delivery or by online payment with credit card. 

Please note that if you do not collect your COD payment two (2) times within a period of one (1) year, OLDB EUROPE Ltd. is entitled to provide you with the option to pay only by online credit card.

 

  • In the case of cash on delivery, the purchase price of the products ordered and the delivery costs are collected by the company operating the collection point or by the company delivering the products ordered immediately before the products ordered are delivered.
  • If you choose home delivery or a pick-up point, the purchase price and delivery costs can be paid via the POS terminal by credit card. In the case of home delivery, the availability of POS terminals is ensured by the company delivering the products.
  • In the case of online payment by credit card, you pay in advance after placing the order on an online payment platform with any credit card that has been qualified as acceptable by the Barion Payment Zrt. system. At the same time as you are redirected to the online payment platform, OLDB EUROPE Kft. will transmit the order ID and amount to Barion Payment Zrt. but will not process your credit card details. OLDB EUROPE Ltd. shall not charge or impose any separate fees, costs or other payment obligations with regard to the choice of online payment by credit card.

If you choose to pay online by credit card, you agree that OLDB EUROPE Kft. will provide Barion Payment Zrt. (H-1117, Budapest, Infopark sétány 1.) as the data controller with the following personal data: your name, the date of the relevant purchase, the order ID and gross amount, and the e-mail address you have provided for your account. The purpose of the data transfer is to provide customer service assistance to customers who make payments in this way, to confirm transactions and to prevent fraud in order to protect users. Online credit card payments are made through Barion's system. Credit card details are not passed to the merchant. The service provider Barion Payment Zrt. is an institution supervised by the National Bank of Hungary, its licence number is H-EN-I-1064/2013.

Delivery of the products ordered

 

 

Except for delivery by OLDB EUROPE Kft.'s own couriers, we deliver the products you have ordered to the delivery address you have specified by using the services of intermediaries, in particular GLS General Logistics Systems Hungary Csomag-Logisztikai Kft. or Packeta Hungary Kft., and we provide the information necessary for delivery and information on delivery to the companies carrying out the delivery.

Every working day at OLDB EUROPE Kft., we continuously aggregate the orders received and, on this basis, we compile the parcels containing the products ordered, order by order. The delivery company will attempt to deliver the completed parcel to the delivery address provided for home delivery or to the pick-up point of your choice no later than the last day of the delivery period indicated on the sub-page of the products ordered, which is expected to be 2-3 working days.

If you have chosen a delivery method other than our own courier service for your order, please contact the GLS General Logistics Systems Hungary Parcel-Logistics Ltd. central customer service for information on delivery issues, on working days between 7:00 and 20:00 at +36 (20) 890-0660 or Packeta Hungary Kft. at +36 (1) 400 8806 during the same period.

If you have chosen to have your order delivered by your own courier, please contact the customer service of OLDB EUROPE Kft. 

What you need to know about the home delivery services provided by GLS General Logistics Systems Hungary Csomag-Logisztikai Kft. and Packeta Hungary Kft.

 

 

If you request a home delivery - and you do not choose the delivery by courier method - the parcel containing the ordered product(s) will be delivered by OLDB EUROPE Kft.; GLS General Logistics Systems Hungary Csomag-Logisztikai Kft. within the delivery period specified on the subpage of the ordered product(s), which takes 2-3 working days for domestic deliveries and 4-5 working days for parcels sent to Romania, the Czech Republic or Slovakia.  If you are the recipient and you are not at home, you can send the parcel to your relatives or neighbours living in the same household. If you would like to exclude any of them from the list of persons entitled to receive the parcel and/or designate another person as the person entitled to receive the parcel, this request will be forwarded by OLDB EUROPE Kft. to GLS General Logistics Systems Hungary Csomag-Logisztikai Kft.Packeta Hungary Kft., OLDB EUROPE Kft. will not be liable for the fulfilment of the request.

It is very important that, if necessary, the home delivery service provider will try to contact you on the phone number you provided in your account or when you made the purchase, so please check regularly that your account or the phone number you provided when you made the purchase is up to date 

Average delivery time

 

 The expected average delivery time for domestic parcels - sent within the borders of Hungary - is 2-3 working days from the date of placing the order. Alternatively, for parcels sent to Romania, the Czech Republic or Slovakia, the average delivery time is 4-5 working days from the date of order placement;

What happens if you don't receive your parcel on time? What can you do if you don't want the product? What is the right of withdrawal for consumers?

 

 

GLS General Logistics Systems Hungary Csomag-Logisztikai Kft. or Packeta Hungary Kft. will attempt to deliver the parcel up to three times. If the delivery of the parcel is unsuccessful for the third time, you will only be able to pick it up at the place indicated in the notice of GLS General Logistics Systems Hungary Csomag-Logisztikai Kft. or Packeta Hungary Kft. within 10 (ten) working days from the third unsuccessful delivery.

In case of delivery by your own courier, if you do not pick up your parcel within the time period chosen by you, our courier will not deliver it again, but your entire order will be cancelled and any amounts you may have already paid will be refunded as if you had cancelled your entire order.

If you do not order delivery of the ordered products by home delivery, you may collect the ordered packages at the collection point indicated by you during the ordering process within 10 (ten) working days of the notification to this effect, if you fail to do so despite the warning notifications received in the meantime by SMS or e-mail, OLDB EUROPE Kft.  will be entitled to withdraw from the contract, and will be notified of such withdrawal by e-mail sent to the e-mail address you have provided in your account. In case of withdrawal by OLDB EUROPE Ltd. we will refund the purchase price and delivery costs already paid to you.

 

 

What can you do if you don't want the product? What is the right of withdrawal for consumers?

 

IMPORTANT! OLDB EUROPE Ltd. also has the right of withdrawal if you do not receive the package within 10 working days of notification!

If, as a natural person, you are not buying from us for a professional, occupational or other business purpose, you are a consumer under the Civil Code and therefore have the right to withdraw from the contract, i.e. from the purchase of the products you have ordered, without giving any reason. There are exceptions, however, where the nature or condition of the product does not allow you to withdraw:

  • for fast-perishing products ordered,
  • for products which, by their nature, cannot be returned
  • for hygiene or health reasons (this applies to dishwashing sponges, scouring pads, etc.)
  • for products which have been opened after receipt

there is no possibility to withdraw without giving reasons.

You may exercise your right of withdrawal up to 14 (fourteen) days from the date of receipt of the package containing the products you have ordered. It is important that you inform us in writing, either by sending us a statement online at info@cleaningstuff.eu or by post. In order for us to be able to manage your cancellation and return smoothly, it is essential that we can identify which order you are placing and which of the products you are not claiming for, so it is essential that you provide us with your written

  • your name,
  • your address,
  • the date of your order,
  • the unique identifier of your order (or, if you cannot find it, other information that identifies your order),
  • the product to which the right of withdrawal applies
  • the date on which you declare your right of withdrawal in writing.

 

If you have already received the product(s) and wish to return them by exercising your right of withdrawal, you must repackage and return them in an undamaged and complete condition. You can do this by

  • return it by post to 1078 Budapest, Nefelejcs utca 7. 2. em. door 3;

the cost of returning the products ordered (including in particular postal charges) to OLDB EUROPE Ltd. In order to ensure a smooth transaction, please return the product(s) concerned without delay after sending your notice of withdrawal, and please note that you have a period of fourteen (14) days to return (i.e. dispatch) the product(s) concerned, starting from the date on which

  • you have sent your withdrawal online, or
  • we have received your notice sent by post.

We will endeavour to refund the purchase price and delivery costs of the returned product(s) immediately as agreed with you. The refund must be made no later than 14 (fourteen) days after receipt of the cancellation notice and the returned product(s) or your credible confirmation of the return of the ordered product(s). We recommend that you obtain proof of return from the post office or our relevant store, as we will be required to make the refund once we have received the product you ordered or credible proof from you that you have returned the product you ordered.

What can you do if you have problems with the product you bought?

 

 

IMPORTANT! When you encounter a faulty product, you should consider the following questions:

-Did you buy as a consumer?

-what is the nature of the defect?

 

What can you as a consumer claim if there is a problem with the products you have bought?

As a consumer, you have several choices to make: you must choose between the so-called "accessories", "product" and "consumer durables" warranty rules, whichever best serves your interests, based on the category of product, the nature of the defect and the time of the claim.

 What is a warranty of fitness for purpose?

Warranty means that OLDB EUROPE Ltd. as the seller of the product, is liable for the defect of the product, specifically for the defect already existing in the product at the time of purchase. Our liability is therefore based on the defect of the product, the cause of which is already present in the product at the time of purchase, but not yet identifiable at that time.

If products purchased from OLDB EUROPE Ltd. turn out to be defective, you as a consumer have the right to claim for a so-called "warranty of accessories" at your choice:

  • you may request the repair or replacement of the ordered product, unless the fulfilment of the claim chosen by you is impossible or would involve disproportionate additional costs for OLDB EUROPE Ltd. compared to the fulfilment of other claims;
  • if you do not or cannot request the repair or replacement, you may request a proportionate reduction of the price or, as a last resort, withdraw from the contract.

We aim to complete the replacement within a maximum of fifteen (15) days. If the time for repair or replacement exceeds fifteen (15) days, we are required to inform you of the expected replacement time. If you agree, we will send you a confirmation of receipt by email. You may switch from the first of the above options to a different accessory warranty, but you will be responsible for the incidental costs of the switch, unless the reason for the switch was given by OLDB EUROPE Ltd. or the switch was otherwise justified.

You have two (2) years from the date of purchase to exercise your warranty rights in relation to the defective product. It is important that you notify OLDB EUROPE Ltd. as soon as you discover a defect in the product, because as you will see in the next paragraph, the burden of proof changes over time. You will have two (2) months from the date of discovery of the defect, within which time the defect you have notified will be deemed to have been notified without delay.

 The first step in making a warranty claim is to prove that a contract has been concluded between you and OLDB EUROPE Kft. OLDB EUROPE Kft. in relation to the product you have purchased - this simply means that you must show/send us the documents proving that you have purchased the product from the webshop. As a consumer, there are therefore no conditions for asserting a claim within six (6) months of the delivery of the package containing the products you ordered, other than the notification of the defect, if you prove that you purchased the product from OLDB EUROPE Ltd. This means that, as a consumer, you do not have to prove, during the first six (6) months, that the defect in the product ordered existed at the time of delivery, i.e. at the time of delivery of the package, unless the nature of the product concerned or the nature of the defect is incompatible with a presumption that the defect which you have discovered existed at the time of delivery. However, after the six (6) months have elapsed, you will have the burden of proving that the defect in the product ordered existed at the time of delivery, i.e. at the time of delivery of the package.

What are the possibilities offered by product warranty rules?

 Product warranty rules may apply if the product is defective because.

  • the product does not meet the quality requirements in force when it was placed on the market, or
  • does not have the characteristics described by the manufacturer.

In the case of product warranty defects, you can make one of two types of claims against OLDB EUROPE Ltd. or directly against the manufacturer:

  • you can request a replacement.

OLDB EUROPE Ltd. (or the manufacturer of the ordered product) shall be released from its product warranty obligation if it proves that:

  • did not manufacture or market the contested product in the course of its business, or
  • the defect was not detectable according to the state of science and technology at the time when it was placed on the market, or
  • the defect in the product ordered is due to the application of a legal provision or a mandatory requirement of a public authority.

If you want to invoke the product warranty rules, you must notify OLDB EUROPE Ltd. of the defect without delay after you discover it. Again, the rule that a defect communicated within two (2) months of the discovery of the defect shall be deemed to have been communicated without delay. It is important to inform OLDB EUROPE Ltd. as soon as possible, because if you inform OLDB EUROPE Ltd. of the defect after two (2) months have elapsed from the discovery of the defect, the communication may be considered late and you will be liable for any resulting damage. You may assert your product warranty claim within 2 (two) years from the date of placing the defective product on the market by OLDB EUROPE Ltd. However, there is an important difference to the warranty for accessories

in the event of a dispute, you have the burden of proof.

The rights of non-consumer customers are much more limited.

If you are not a consumer, you will not be able to enforce your product warranty claims, and the rules for enforcing the rules on ancillary guarantees will be stricter, as follows:

  • you have one (1) year after the purchase date to assert your warranty claim,
  • a defect notified by you within two (2) months of the discovery of the defect shall not be deemed to have been notified without delay;
  • after receipt of the package containing the products ordered, you must prove that the defect in the products ordered existed at the time of delivery, i.e. at the time of delivery of the package.
